Habeas Corpus Prevented the Deportation of a Venezuelan TPS Beneficiary in the United States

Over the past several months, many TPS beneficiaries have shared the same concern: if they currently hold Temporary Protected Status, can they still face detention or deportation proceedings?

In an interview on Por la Mañana, immigration attorney Héctor Benítez analyzed a case that brings this conversation back into focus.

The case involves José, a TPS beneficiary who was only minutes away from being removed from the United States despite maintaining valid immigration protection and having an active family-based immigration process.

According to Benítez, one of the most significant legal elements in this case was the scope of the Declaratory Reliefissued by Judge Chen in December 2025, a decision that strengthens protections available to certain TPS beneficiaries and establishes important limitations against detentions that conflict with that status.

However, the case also highlighted an important lesson: having a valid immigration benefit does not always automatically eliminate the risk of administrative errors, delays, or incorrect interpretations within the system.

In this situation, legal strategy became critical.

The use of a Habeas Corpus action before a federal court allowed the enforcement of the removal to be stopped and opened the door to judicial review at a point when traditional immigration channels appeared exhausted.

Attorney Gustavo Guerrero explains that this type of federal litigation seeks to prevent irreversible consequences caused by procedural errors and ensure that legal protections are properly applied.

Beyond the individual outcome, this case leaves an important message for the immigrant community: understanding the real scope of each immigration benefit, keeping immigration processes updated, and acting quickly in any situation can make a meaningful difference.
