Immigration Options Beyond Asylum
For many people, asylum may seem like the only option for remaining in the United States. However, there are other immigration pathways that may be worth exploring, depending on each person’s circumstances and eligibility.
During an interview on Por la Mañana con Carlos Acosta, our attorney Gabriel Virla, from Benme Legal, discussed different options immigrants may consider as alternatives to an asylum application.
There are different immigration pathways
During the interview, Gabriel explained some of the available options, including:
- Employment-based immigration processes and labor certification.
- Family-based petitions.
- EB-2 categories.
- U and T visas for certain victims of crime, labor exploitation, or human trafficking.
He also emphasized that having a pending asylum application does not necessarily mean a person must rule out other immigration options, as long as they meet the requirements for those processes.
Why every case needs an individual review
The attorney also discussed the risks of filing asylum applications without sufficient legal grounds and the importance of having documentation to support the circumstances of each case.
Every immigration process has its own requirements, steps, and conditions. That is why it is important to understand the available options and evaluate which one may be appropriate for each individual situation before making any decisions.
