In an interview, our attorney Héctor Benítez, from Benme Legal, explained the main legal precautions immigrants in the United States should keep in mind if they encounter immigration authorities.

Knowing your rights is essential

During the conversation, Benítez highlighted several important recommendations:

• If you have established immigration status, try to carry documents that can verify your status.
• If you have a pending case or unresolved immigration or criminal matters, exercise your right to remain silent.
• Do not sign any documents without first receiving legal advice.
• Ask to speak with an attorney if you are facing immigration detention.

He also explained the difference between following officers’ instructions and answering questions that could have legal consequences. He warned that resisting authorities could complicate a case and affect a future defense strategy or bond request.

Other changes you should keep in mind

The interview also covered proposed changes affecting student and journalist visas, particularly the Duration of Statuspolicy.

According to Benítez, a court decision temporarily keeps the previous system in place while the legal process continues. For this reason, F-1 and I visa holders should stay informed about future decisions that could change the applicable rules.
