Prosperi-Quintana clears up an important point to avoid panic: it’s not accurate to say that someone will be automatically deported at their first hearing just for showing up without a lawyer. That said, she warns there is a real risk that the judge will move forward with the formalities of the process and not grant additional time to find representation.

The decision, known as Matter of A-K-R-, reflects a stricter stance and makes it essential to take hearing preparation seriously. That’s why our attorney insists you should never assume there will always be another chance to find a lawyer. Her recommendation is clear: if representation isn’t possible, at the very least get a professional consultation beforehand to understand the risks and the defenses available to you.

Prosperi-Quintana also addresses the shift toward online filing of immigration forms, including certain applications for work permits, travel, asylum, and naturalization. The change can speed up receipts and

communications, but it introduces new technological challenges and calls for extra care: information submitted under penalty of perjury must be accurate and consistent across all of your applications.
