The T nonimmigrant status, or T visa, is designated for victims of human trafficking and their qualifying family members, allowing them to remain in the United States for up to four years. Eligibility requires victims to assist in the detection, investigation, or prosecution of human trafficking, or to qualify for a waiver. T visa holders are entitled to work legally, access federal and state benefits, and may apply for legal permanent residency after three years or the conclusion of related investigations. Human trafficking is defined here as the coercive or deceptive recruitment, harboring, transportation, or acquisition of a person for forced labor or commercial sex acts, with an exception for minors under 18, where coercion need not be proven.

Yes, there is an annual limit of 5,000 T visas for principal victims of human trafficking, but this limit does not apply to eligible family members.

How long can I stay in the U.S. with a T visa?

The T visa is valid for up to 4 years. Under certain conditions, you may be eligible to apply for permanent residency (green card) after 3 years or once the investigation or prosecution of the trafficking is completed, whichever comes first.

Does the T visa allow me to work in the U.S.?

Yes, individuals with a T visa are eligible to receive an Employment Authorization Document (EAD).
